Greg Hensrude has an active litigation and pre-litigation practice that focuses on representing corporations with respect to a full range of issues. Much of Mr. Hensrude’s work occurs outside of the courtroom, where he assists companies with services ranging from the negotiation and drafting of contracts to the acquisition of intellectual property. Mr. Hensrude also has experience in every aspect of litigation, from filing a lawsuit to serving as lead counsel at trial. Mr. Hensrude has litigated many different kinds of complex cases, but focuses on intellectual property, contract disputes, the defense of professionals, and product defect claims.

Corporate Guidance and Counsel

As a member of Klinedinst’s General Counsel, Intellectual Property, and Business Litigation teams, Mr. Hensrude has built relationships with corporate officers to become a trusted resource for help in virtually every aspect of running a successful enterprise. Mr. Hensrude prides himself on being the “front line” legal contact for most of his clients, providing them guidance related to the many subjects important to small and medium-sized businesses. For example, he has advised clients in acquiring and licensing intellectual property, resolving trademark disputes, expanding their operations internationally, avoiding antitrust liability, and has negotiated, reviewed and drafted hundreds of contracts covering almost every subject matter. Mr. Hensrude also serves as General Counsel of Klinedinst PC.

Mr. Hensrude also works diligently on behalf of corporate clients to secure and protect trademarks and other intellectual property both in the United States and abroad. He prosecutes and opposes trademark applications before the United States Patent and Trademark Office, and (with the assistance of counsel all around the world) helps procure trademarks in most every nation in the world. Mr. Hensrude has assisted clients in acquiring patents and other intellectual property, and in formulating strategies to monetize that intellectual property. Because many of his clients are in the first ten years of their existence, Mr. Hensrude has developed expertise in helping emerging growth companies in the internationalization of their operations.

Mr. Hensrude’s clients include companies in the wholesale and manufacturing industries, the retail sector, technology firms, service organizations, real estate investors, and internet-based enterprises.

Complex Litigation

Mr. Hensrude practices in all areas of complex litigation, and focuses on several:

Intellectual Property: Mr. Hensrude focuses his intellectual property litigation practice on copyright and trademark infringement claims, but he also has experience working on patent infringement and licensing claims. His representation has included both plaintiffs and defendants, working both as lead and local counsel.

Professional Liability: Mr. Hensrude has litigated over a hundred professional liability claims, mostly for lawyers and accountants, but also including real estate brokers, insurance agents, and professional fiduciaries.

Product Defect: Mr. Hensrude also represents manufacturers in product liability actions, both in preventing claims from becoming litigated matters, and in defending those suits once filed. Mr. Hensrude has also assisted clients with alleged product safety issues in the United States and abroad.

Contractual Disputes: Often coinciding with other types of litigation, Mr. Hensrude has also litigated many contract causes of action, from breaches of services contracts to alleged breaches of intellectual property contracts to misappropriation of trade secrets protected by employment agreements.

Mr. Hensrude has also litigated probate matters, class actions and collections. As a member of the litigation team at Klinedinst PC, Mr. Hensrude has successfully litigated many matters to superb client results.

Several examples include:

Obtained judgment in favor of the defendant attorney after a three-day trial in a legal malpractice case with claimed damages in excess of $3 million

Served as lead counsel for a real estate investor and won a significant jury verdict for the company following a two week trial

Defeated nearly $20 million in alleged damages in a professional liability matter through pre-trial motion

Prevented class certification, which in turn terminated the suit, with thousands of alleged class members and millions in alleged damages (and prevailed on appeal)

Accomplished a hard-fought victory in a legal malpractice case with claimed damages of around $19 million

Successfully litigated to judgment a contentious legal malpractice case, after taking lead role in trial court, arbitration, and appeal

Mr. Hensrude has also assisted clients with regulatory actions and investigation, such as those before the Financial Industry Regulatory Authority (FINRA, previously NASD), the California Board of Accountancy, and the California State Bar.
