FEHC Adopts Modified Sexual Harassment Training Regulations

In early February, the Office of Administrative Law withheld approval of the FEHC’s proposed sexual harassment training regulations issued in November 2006. On February 27, 2007, the FEHC proposed modifications. These modifications involve the definitions of “qualified trainer” and “subject matter expert” in the proposed regulations. Specifically,

  • The definition of “effective interactive training” has been revised and moved to a different position of the “Definitions” section;

  • The definition of “qualified trainer” is removed;

  • A definition for “subject matter experts” has been added specifically to the “Definitions” section, and the definition has been expanded;

  • The subsection (c) involving “trainers or educators” is removed, and a definition of “trainers or educators” has been added to the “Definitions” section, and slightly modified.

The FEHC considered public comments on the modifications at its March 27 meeting. It will resubmit proposed regulations to the Office of Administrative Law for approval.
