Status of Meal and Rest Period Proposed Regulations

According to the Division of Labor Standards Enforcement’s (“DLSE”) website, the written comments received in the last period for comments for the proposed meal and rest period regulations (which expired on July 25, 2005) are still in the process of being reviewed and analyzed. Once the DLSE completes its review, if it is determined that further revisions to the proposed regulations are needed, the regulations will, by the provisions of the rulemaking process, be submitted for even further public comment. If no further revisions are needed, the proposed regulations will be submitted for approval and finalization. In the interim, California employers should continue to follow the meal and rest period laws as set forth in the Labor Code and Industrial Welfare Commission Wage Orders.
